Terms of Use and Privacy and Security Policy for youshare.org

Welcome to YouShare, an online resource for connecting people willing to help with people needing help. The YouShare website and program are operated by YouShare, Inc. an Illinois non-profit corporation (“we”, “us” or “YouShare”).

The following Terms of Use and Privacy and Security Policy (“Terms”) are binding on all Users, Participants and us as described below. By using this website (the “Website”) as becoming a YouShare Participant as described below, you accept these Terms and agree to comply with these Terms. If you do not agree to these Terms, you cannot use the Website or participate in the YouShare program described in these Terms (the “Program”).

1. The YouShare Program

Overview.    YouShare enables approved persons, families or organizations with a need (we refer to them as “Families”) for goods or services (we call that a “Need”) to work through the Program to have their Needs posted on the YouShare Website where the needs can be viewed and fulfilled registered groups, individuals or organizations we call “Neighbors.” Our Program facilitates the meeting of a Need but does not itself fulfill it – determination of the Need and the actual fulfillment of the Need are the responsibility of the various “Participants” in the Program described below.

Participants.    The YouShare Program involves a number of important participants (“Participants”) whose roles and responsibilities are described more fully below:

Families are individuals and families with a Need who become Participants in the Program through an Advocate.

Advocates are businesses, groups or other organizations that identify, recruit and screen Families to participate in the Program, assist Families in using the Program and facilitate interaction with Neighbors who are willing to fulfill the Needs of those Families. Advocates become a Participant through a Field Partner.

Neighbors can be almost any person or group willing to connect with families in need by sharing goods or services and, when possible, be open to an on-going relationship that will be mutually transformative. Neighbors are recruited by Field Partners.

Field Partners are typically Churches, non-profit organizations, spiritual communities, schools, businesses and other established community groups dedicated to serving the less fortunate in their communities. Field Partners are responsible for promoting YouShare in their communities, recruiting and training Advocates and recruiting and screening Neighbors. Regional Partners recruit and train Field Partners in various areas.

Regional Partners are typically non-profit community based agencies with a regional or local focus. A Regional Partner must have good relationships with other providers in the community and have sound financial and organizational systems and supports. YouShare recruits and trains Regional Partners.

Families.    Families are recruited and assisted by our Advocates. Individuals and families wishing to become a YouShare Family should contact one of our Advocates or encourage their community group to become an Advocate. The Advocate will assist you with the Program and help you identify your needs so that they may be posted as a Need on the Website. When we post the Need of a Family, we do not include the identity of the Family other than a general geographic location. If a Neighbor responds to a Need, the Program generates an email to the Neighbor with the contact information of your Advocate. The Advocate will reveal your identity to the Neighbor in order to facilitate the fulfillment of your Need, and you must consent to that disclosure. The manner in which the Need is fulfilled is matter to be addressed by the Family, Advocate and Neighbor on an individual basis. YouShare is not involved in that process and does not review or monitor the posting of any Need.

Advocates.    Advocates must apply to, register with and be approved by one of our Field Partners. Once approved, an Advocate is solely responsible for screening and sourcing each Family, evaluating the legitimacy of the Need and correctly posting the Family’s Need on the Website. The Advocate reviews responses to the Need and coordinates the fulfillment of the Need by the responding Neighbor. Advocates are given access to administrative features of the Website for this purpose only. Advocates are also encouraged to assist Neighbors in participating in the Program.

Neighbors.    Individuals interested in becoming a Neighbor must complete the registration process including selecting a Field Partner. In the registration process, a Neighbor will complete a “Profile” on the Website including specifying the type of needs the Neighbor is willing to consider. We use the Profile solely in order to seek a match with a Need; the Profile is not publicly displayed or available. If your profile matched the Need, the Program sends you an email with the contact information of the Advocate. If the Neighbor decides to respond to the need or has questions, the Neighbor can contact the Advocate. The Neighbor and Advocates are responsible for addressing the Need. YouShare has no further involvement in that process.

Field Partners.    We rely on Field Partners and in some cases, Regional Partners to oversee and assist on the implementation of YouShare in the community. Field Partners must be able to screen and approve Neighbors offering services that involve contact with children, as well as have the ability to oversee the activities of their Advocates. We rely on Field Partners to screen and approve Advocates and Neighbors.

Limits on YouShare’s Obligations.   Our role in the Program is limited to recruiting and monitoring Regional Partners. We expressly disclaim all responsibility for the screening or sourcing of any Family, Neighbor or Need or to monitor any communication or transaction between any Neighbor and any Advocate and any Family. Families and Neighbors assume all risks of dealing with each other.

2. Special Rules for Safe Families and Child Placement

YouShare enables Advocates to post as a Need a Family’s desire to place a child through the Safe Families for Children™ service. Information about Safe Families for Children can be found at www.safe-families.org. Safe Families for Children is operated in a local community by a local or regional community group or by “Hubs” under a license from The Safe Families Network. Only Safe Families who have completed required training and been approved as a Safe Families by Safe Families for Children are eligible to respond to a Need for a Safe Family.

3. Tax Deductibility

YouShare is recognized as a tax exempt entity under Section 501(c)(3) of the Internal Revenue Code of 1986, as amended. Contributions to or through YouShare or the Advocates to Families through the Program may be tax deductable. You are solely responsible for determining the proper tax treatment for any gift you make through the Website and the Program. YouShare does not and will not provide any tax or legal advice to you in connection with your activity. These Terms do not attempt to define the tax implications of participating in the Program or addressing a Need. If you participate in the Program, you should consult with your own accountants, tax and legal advisors.

We respect the privacy and other rights of all our Participants. We will strive to provide each Neighbor with any information a Neighbor requests about YouShare and will not identify you outside the Program as a donor or Participant except as you consent. YouShare will not publish, sell, use or rent any information from or about a Neighbor or any other Particpant except in connection with the operation of the Program.

4. Proprietary Rights

Participants and all persons who use the Program or view the Website (Participants and such users, “Users”) understand that the look, feel, design and content of the Website and the Program are the sole property of YouShare. The Program is proprietary to YouShare and may not be copied, resold, reused or reproduced in any way. All information, postings and other materials (“Postings”) posted on or transmitted through the Website, are the sole responsibility of the person from whom such Posting originated. YouShare does not control, and is not responsible for Postings made available through the Program.

“YouShare” and the “youshare” logo are trademarks and service marks of YouShare who owns and retain all proprietary rights in the Program, the Website and all material and information posted on the Website ("Content"). The Website contains copyrighted material, trademarks and other proprietary information of YouShare and its licensors. You may display and print limited copies of the Content for your personal, non-commercial use in connection with your participation in the Program (except as provided herein), but you may not alter, modify, publish, distribute, publicly display or sell any Content or other such proprietary information, or otherwise copy or transmit any Content or other such proprietary information without the express, written permission of YouShare. All Postings shall be considered Content, and the person making the Postings grants to YouShare the unrestricted right to use the Content in furtherance of the Program.

YouShare may, to the extent permitted by law, access, read, preserve and disclose a Participant’s account and information only in order to: (a) comply with any applicable law, regulation, legal process, or governmental request; (b) detect, prevent, or otherwise address fraud, security, or technical issues; (c) track the success and operation of the Program; (d) assemble non-identifiable information for use in promotional materials; or (e) protect the rights, property, or personal safety of YouShare, Users, or the public.

5. Acceptable Use

The Website may be used only in connection with the Program. Users may not use the Website for any other purpose -- commercial or otherwise -- except as we expressly approve in writing in advance. Your use of the Website and participation in the Program shall be in strict compliance with these Terms, YouShare’s Privacy Policy, all other procedures and guidelines set forth on the Website and applicable law. You may not engage in advertising to, or solicitation of, any Participant or any other Person to buy or sell any products or services through the Website. Illegal and/or unauthorized uses of the Website, including collecting the name, email address or any other personal or confidential information of any Participant or any other Person by means for any reason is prohibited. Although YouShare assumes no obligation to monitor the conduct of any User on or off the Website, it is a violation of these Terms to use the Website or Program or any information obtained from the Website in order to: (i) harass, abuse, or harm another person (including in the course of posting, responding and fulfilling a Need), (ii) prevent or exclude any Participant using the Program and Website in compliance with this Agreement from accessing, viewing or fulfilling a particular Need, (iii) contact (other than in connection with fulfilling a Need), advertise to, solicit, or sell anything to any Participant or other Person for any reason without their prior explicit consent, (iv) breach or attempt to breach any security feature of the Program or Website, or harm or attempt to harm the Program, YouShare or any User by a virus, taking of information or other disruptive or malicious program or code, or (v) implement any overlay, popup or similar feature.

6. Limitations on Service

Users acknowledge we may establish limits and restrictions concerning participation in the Program in order to fulfill the goals and objectives of the Program as we determine in our discretion. Users agree that we have no responsibility or liability for the deletion or failure to store or display any Content maintained or transmitted in the Program. You acknowledge that we reserve the right at any time to modify or discontinue the Program (or any part) with or without notice.

7. Data Protection

Unfortunately, no data protection method or combination of methods can be guaranteed 100 percent secure. We take commercially reasonable steps to protect information stored on or transmitted through the Website, but we cannot ensure or warrant our ability to do so. As a result, you use Content, the Program and the Website at your own risk. We will not be liable for disclosures of any information stored on or transmitted through the Website due to errors in transmission or the unauthorized or illegal acts of a third party. We reserve the right to monitor use of the Website and all transactions in the Program, for the purposes of quality control, security, legal compliance and other Program needs.

8. Disclaimers

We are not responsible, and shall have no liability, for any incorrect, misleading or inaccurate Content posted on the Website or any liability, cost or expense any User may incur in connection with the Program, whether caused by any User or other Person or by any of the equipment or programming associated with or utilized in the Program. YouShare assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communications.

Under no circumstances will YouShare be responsible for any loss or damage, including personal injury or death, resulting from any use of the Website or participation in the Program, any Content posted on the Website or transmitted to, or any interactions between, any Participant or User of the Website, whether online or offline. YouShare neither represents, warrants, covenants guarantees, nor promises any specific results from use of the Website or the Program.

YOUSHARE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE WEBSITE AND THE PROGRAM OR ITS CONTENTS OR WEBSITES TO WHICH IT IS LINKED, WHICH ARE ALL PROVIDED FOR USE "AS IS." YOUSHARE ALSO MAKES NO REPRESENTATIONS AND DISCLAIMS ANY AND ALL WARRANTIES AS TO WHETHER THE INFORMATION ACCESSIBLE VIA THE WEBSITE OR ANY WEB SITE TO WHICH IT IS LINKED, IS ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of Liability

Users and Participants understand that any and all decisions made by any User with respect to the Program are the sole responsibility of the User alone. YouShare cannot and does not verify the accuracy of information relating to Needs, Families or Neighbors. YouShare shall not be responsible for, have any duty or obligation with respect to, or have or assume any liability for: (a) decisions or interactions resulting (directly or indirectly) from participation in the Program; or (b) any damages, costs, losses or expenses a Participant or User incurs as a result (directly or indirectly) of gift or service to a Family or as a result (directly or indirectly) of utilizing the Program or information received in connection with the Program. In addition, in no event will YouShare be liable to any Participant, User or any third person for any damages, costs, losses or expenses, including any lost capital, lost profits or special, incidental, consequential or punitive damages arising from your use of the Website or participation in the Program, even if YouShare has been advised of the possibility of such damages, costs, losses or expenses.

10. Termination of Access and Updates

We have the right to terminate, limit or suspend any User access to all or any part of the Website at any time, with or without notice, for any reason, including without limitation, for any conduct that we believe is in violation of these Terms or any applicable Laws or is harmful to the interests of another user, any third party or the Website.

Updates to these Terms will be posted on the Website and will be effective upon posting. You agree to periodically review the Website Terms of Use for any amendments. Your continued use of the Website after posting amended Terms shall constitute your acceptance of and agreement to be bound by the Amended Terms of Use.

11. Disputes with other Participants

Participants are solely responsible for their interactions with any other Participants or any other User (even to the extent prohibited under these Terms) or any Advocate and any disputes that may result from such interactions. YouShare reserves the right, but has no obligation, to monitor disputes between Participants and such persons.

12. Governing Law; Resolution of Disputes; Arbitration and Waivers

This Agreement is governed by the laws of the State of Illinois, USA, without regard to its choice of law or conflict of law provisions. If any dispute arises between you and YouShare, including, without limitation, any dispute arising from or relating to the Website or the Program, you agree that all such disputes will be determined exclusively by final and binding arbitration, in accordance with the then existing commercial rules of the American Arbitration Association. The arbitration shall be heard and adjudicated by one arbitrator to be selected by you and YouShare. Any award will be final, binding and conclusive upon the parties, subject only to judicial review provided by Illinois statute, and a judgment rendered on the arbitration award can be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, either you or YouShare may seek any injunctive relief in a state or federal court in Chicago, Illinois, as may be necessary to preserve rights pending the completion of arbitration and YouShare may seek any injunctive relief in a state or federal court in Chicago, Illinois, or another court of competent jurisdiction, at any time against any violations of Section 2 (Proprietary Rights) or Section 3 (Acceptable Use) of this Agreement.

13. Miscellaneous

This Agreement, accepted upon use of the Website and further affirmed by becoming a User, contains the entire agreement between you and YouShare regarding the use of the Website or the Program. This Agreement may not be orally amended. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. Privacy Policy

  • YouShare will not rent or sell your personal information about any User or Participant to third parties.
  • By becoming a Participant, you agree to receive emails based on your registration information, confirmation of email address or password changes, or customer service inquiries regarding activity in your account.
  • By default, you will receive update emails on your activities that are sent to Participants through the Website. YouShare will not disclose your email address to our partners in any case -- these emails are sent through a webform without any third party learning your address. You can choose not to receive these emails through a preference on the Website.
  • By default, you may receive periodic newsletter emails from youshare.org. The frequency of these newsletters may vary but will be no greater than once per month. You can choose not to receive these newsletters through a preference on the Website.
  • YouShare will not disclose your personally identifiable profile and activities to any third party without consent. YouShare reserves the right to record and display anonymous sharing activity on the Website and display the general regions where our neighbors are located.
  • YouShare’s service providers may be provided access to your information in order for them to fulfill their oversight responsibility. All such access shall be under appropriate confidentiality agreements and limited to use to provide services to youshare.org.
  • If you follow any links which remove you from the Website, this Privacy Policy no longer applies. YouShare does not control the privacy policies or the privacy practices of any third parties.
  • This Website is intended to be used by adults. It is not intended for children, and YouShare does not want to collect any personal information for users who are under the age of 13. youshare.org recommends that parents do not post, or permit others to post, any personally identifiable information with respect to persons under the age of 13.
  • youshare.org may update or modify this Privacy Policy from time to time. If any changes are made, YouShare will reflect the date on which any such changes are made and posted by updating the "last updated" date at the top of the page. Please be sure to check this page periodically for changes. This Privacy Policy was last changed and posted on the Website on October 1, 2010.
